The Armory Rental Policy

1. Rental deposit (25% of the rent, which is non-refundable) is required for Washington Avenue Armory to hold space.
2. The balance of all expenses (i.e. food service, labor rental etc.) must be paid THREE (3) DAYS PRIOR to the event. Payment must be paid by credit card, cashier's check, money order, or cash. No personal checks will be accepted.
3. No food or beverages may be brought into the premises of Washington Avenue Armory.
4. The Lessee is responsible for any and all damage to the furnishings, equipment, and property of Washington Avenue Armory by Lessee's invitees, guests, employees or agents and the Lessee shall pay all reasonable costs for repair upon its discovery.
5. On any unpaid balance a 1.5% interest fee will be applied for each 30 days the balance remains unpaid.
6. In the event of litigation by Washington Avenue Armory to enforce this Agreement, Washington Avenue Armory shall be entitled to reasonable attorney fees and court costs, including all costs of discovery.
7. Washington Avenue Armory retains the right to determine and assign all appropriate security and staff personnel or services necessary to properly serve and protect the public. Costs of these services shall be the responsibility of the Lessee. Any staff provided by the Lessee shall be under the jurisdiction of Washington Avenue Armory. All event personnel are in addition to rental charges.
8. If, for any cause not specifically dealt with herein, Lessee fails to present the event as scheduled, or requests a change of date for the scheduled event, Washington Avenue Armory shall retain the rental deposit and shall look to Lessee for reimbursement of any out of pocket expenses incurred by Washington Avenue Armory in preparation for the event. Lessee, may request a change of date once and it must be in the same calendar year as the original date.
9. Washington Avenue Armory will not be responsible for any merchandise, signs, equipment, etc. left on the premises. Furthermore, Washington Avenue Armory reserves the right to clear the premises and dispose of any property located thereupon and will bill the Lessee for any charges incurred in connection with such clearing or disposal.
10. Washington Avenue Armory reserves the right to change assigned rooms for events at Washington Avenue Armory's discretion upon notification to the customer.
11. Indemnification: To the fullest extent permitted by law, Lessee shall indemnify, save and hold harmless Washington Avenue Armory, Albany Basketball & Sports Corporation, Albany Patroons Inc., their officers, agents, and employees from and against any and all claims, demands, actions, or causes of action, costs and penalties of any nature or character, caused in whole or in part by any negligent acts or omissions of Lessee. This includes anyone directly or indirectly employed by Lessee.
12. Insurance: The Lessee must acquire a $1,000,000.00 insurance liability certificate, listing Albany Basketball & Sports Corp. & Albany Basketball & Sports LLC as additionally insured and it must be received by Washington Avenue Armory seven days prior to the scheduled event or the event will be cancelled. A certificate of Workers' Compensation Insurace with Albany Basketball & Sports Corp. & Albany Basketball & Sports LLC as certificate holder is also required seven days prior to event. All charges are subject to change without notification.
